This Indenture made the third day of April in the year of our Lord one thousand eight hundred and seventy five between Richard M. Gidley of Charlottetown Queens County in the Province of Prince Edward Island Carpenter and Mary Ann Gidley his wife of the one part and Thomas Sullivan Henry of Georgetown in Kings County in the said Province sail maker of the other part. Whereas the said Richard M. Gidley hath contracted and agreed with the said Thomas Sullivan Henry for the absolute sale to him of the inheritance in fee simple in possession of

and in the lands and hereditaments hereinafter described with the appurtenances at or for the price or sum of one hundred Dollars of lawful money of the said Province.

Now This Indenture Witnesseth that in consideration of the sum of one Hundred Dollars to the said Richard M. Gidley in hand well and truly paid by the said Thomas Sullivan Henry at or immediately before the Sealing and Delivery of these presents (the receipt whereof is hereby acknowledged) He the said Richard M. Gidley Hath granted bargained sold aliened released and confirmed and by these presents Doth grant bargain sell alien release and confirm and she the said Mary Ann Gidley his wife for the purpose of releasing and extinguishing her right of dower of and in the hereditaments hereinafter mentioned Hath remised released and disposed of and by these presents Doth remise release and dispose unto the said Thomas Sullivan Henry his Heirs and Assigns all that piece or parcel of land situate in the Royalty of Georgetown being Pasture Lot number fifty five (55) which said Lot is bounded on the West by pasture Lot Fifty six (56) in the East by Pasture Lot number Forty three (43) and on the south by the Main Post Road leading from Charlottetown to Georgetown which said Lot is more particularly delineated and described on the Plan of the said Royalty Kept in the Office of the Registrar of Deeds and Keeper of Plans for the said Province. Together with all and singular the easements ways rights privileges and advantages whatsoever to the said piece or parcel of land hereditaments and premises belonging or in anywise appertaining and the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof. And the estate right title interest inheritance use trust possession property claim and demand whatsoever both at Law and in Equity of them the said Richard M. Gidley and Mary Ann Gidley his wife and each of them of in to or out of the said premises or any part thereof. To Have and To Hold the said piece or parcel of land and hereditaments before described with the appurtenances unto the said Thomas Sullivan Henry and his heirs to the use of the said Thomas Sullivan Henry and his heirs and assigns forever subject Nevertheless to the payment of the Quit Rents to become due or other the compositions in lieu thereof exceptions reservations covenants and conditions in the original grant or letters Patent of the said premises reserved and contained. And the said Richard M. Gidley doth hereby for Himself his heirs Executors and Administrators covenant promise and agree with and to Thomas Sullivan Henry his heirs and assigns in manner following that is to say that he the said Richard M. Gidley now hath in himself full power and authority to sell the said Lands hereditaments and premises hereinbefore granted and released or intended so to be with the appurtenances unto the said Thomas Sullivan Henry and his heirs to the uses and in manner aforesaid And that the said piece or parcel of land hereditaments and premises shall and lawfully may according from time to time and at all times hereafter be held and enjoyed and the rents issues and profits thereof received and taken by the said Thomas Sullivan Henry his heirs and assigns to and for his and their own absolute use and benefit without any lawful let suit trouble denial eviction ejection molestation or disturbances whatsoever from or by the said Richard M. Gidley or his Heirs or any person or persons lawfully or equitable claiming by from through under or in trust for him or them. In Witness Whereof the said parties to these presents have hereunto their hands and seals subscribed and set the day and year first above written.
