Rennie of Saint Johns Newfoundland presently residing at Charlotte Town aforesaid of the other part. Whereas Janet Emma Rennie or Hoyles now deceased spouse of the Reverend William H Hoyles some time of Fogo presently of Brigus in the Island of Newfoundland Clerk departed this life on or about the Seventeenth day of May Eighteen Hundred and forty Eight and was at the time of her decease lawfully siezed of and in certain lands and premises being part of Lot or Township Number twenty three in Prince Edward Island as particularly described in a certain Indenture or deed of partitition executed between the said Janet Emma Rennie and David Stuart Rennie of date the Sixteenth day of August One Thousand Eight hundred and forty two and duly Registered And Whereas the said Janet Emma Rennie or Hoyles having died without issue her said lands and premises descended to and became vested in her surviving Brothers by the said David Stuart Rennie, William Frederick Rennie and the said Robert Rennie in equal proportions And whereas the said Robert Rennie has now agreed with the said David Stuart Rennie for the absolute Sale to him of his the said Robert Rennie undivided one third part or share of the said lands and premises Now this Indenture Witnesseth that for and in consideration of the Sum of Five Hundred Pounds lawful current money of Prince Edward Island by the said David Stuart Rennie to the said Robert Rennie in hand will and truly paid the receipt whereof is hereby acknowledged he the said Robert Rennie hath Granted, bargained sold aliened released and confirmed and by these presents doth Grant bargain sell alien release and confirm unto the said David Stuart Rennie his heirs and assigns All his the said Robert Rennie’s undivided one third part or share of and in all that part or portion of Lot or Township Number Twenty three in Prince Edward which lies to the North of a partition line which in the foresaid deed of partition is described as follows Commencing at a stake fixed on the Cavendish Road in the Northern boundary of land leased to John Orr (which said land held by John Orr is bounded on the North by Farm Number 15 On the East by Robert Orr’s Land On the South by Robert Winters Creek and on the West by the Cavendish road) from thence running East to the boundary line of Township Number Twenty four from thence return to the place of commencement and follow the Cavendish Road southerly to the North side of land leased to William Shields then running west to the boundary line of Township Number Twenty two agreeably to a plan annexed to said deed of partition and which part or portion of said Township is bounded as follows by on the South by the foresaid partition line On the West by the division line of Townships Number Twenty two and twenty three On the North by the Gulph of St Laurence and on the East by the division line Between Lots or Township numbers twenty three and twenty four together with all Houses fences trees woods ways waters easements profits privileges commodities emoluments hereditaments and appurtenances whatsoever to the said land and premises belonging or in any mde<<??>> appertaining or therewith usually held occupied or enjoyed and the Reversion and reversions remainder and remainders Yearly and other rents issues and profits thereof and all deeds evidences and writings to the said land and premises relating To have and to hold the said land and premises with the Hereditaments and appurtenances hereinbefore mentioned and described unto the said David Stuart Rennie his heirs and assigns to the only proper use and behoof of the said David Stuart Rennie his Heirs and assigns forever but subject to such leases or agreements to lease any part or parts of said land and premises as have been heretofore Granted by the said Robert Rennie or his ancestors in conjunction with the other proprietors of said Township and to the conditions of the original Grant of said Township <<rest of line crossed out>> from the Crown. And this Indenture further Witnesseth that for the consideration aforesaid the said Robert Rennie hath Granted bargained sold assigned transferred and Set over and doth by these presents Grant bargain sell assign transfer and set over unto the said David Stuart Rennie his executors administrators and assigns all his the said Robert Rennie share of all and every the Rent and Rents sum and Sums of money which for or in consideration of the use or occupation of the said land and premises or any part or parts thereof have accrued and become due and payable any Tenant or tenants person or persons whomsoever who is or are or have been in the use or occupation of the same or of any part thereof and of or from any person or persons who may have heretofore acted as attorney or agent for collecting the Rents accruing from the said land and premises or any part thereof To Have and to Hold receive and Enjoy the said Rents and Sums of Money and other the premises hererinbefore assigned unto the said David Stuart Rennie and his Heirs Executors administrators and assigns as and for his and their own proper monies and effects absolutely forever and for the the consideration aforesaid he the said Robert Rennie hath made constituted and appointed and by these Presents doth make consitute and appoint the said David Stuart Rennie his heirs executors and administrators his true and lawful attorney and attornies irrevocable in his own name or in the name of the said Robert Rennie but to and for the use of the said David Stuart Rennie his heirs executors administrators and assigns to demand and receive the said Sum and Sums of Money Rents and other the premises hereby assigned and to sue for the same and to take all other lawful ways and means for the recovery thereof and one or more substitute or substitutes under him or them to nominate and appoint giving hereby and Granting to the said David Stuart Rennie his Executors administrators and assigns and his or their other substitutes his whole power and authority in the premises and ratifying whatsoever they may lawfully do in the premises And the said Robert Rennie for himself his Heirs executors administrators and assigns doth hereby covenant promise and agree to and with the said David Stuart Rennie his heirs and assigns in manner following that is to say that now at the time of the sealing and delivery of these presents he the said Robert Rennie is lawfully and rightfully seized of and in the aforesaid lands and premises hereby Granted and Released with the appurtenances of and for an Estate of inheritance in fee Simple in possession and hath full power to convey the same unto the use of the said David Stuart Rennie his Heirs and assigns in Manner aforesaid And also that it shall be lawful for the said David Stuart Rennie his heirs and assigns at all times hereafter quietly to hold and possess the said Land and Premises and to receive the rents issues and profits thereof for his and their own use without let or interruption of or from the said Robert Rennie or his heirs or any person or persons claiming by from or under him or them And further that he the said Robert Rennie and all persons claiming by from or under him shall at all times hereafter at the request and at the cost and charges of the said David Stuart Rennie his heirs and assigns make do and execute all other such acts deeds and assurances in the law for the better assuring to the use of the said David Stuart Rennie the land and premises hereinbefore Granted and released and for the better assigning to him and enabling him to recover the said Rents and Sums of Money hereinbefore assigned as by the said David Stuart Rennie his heirs or assigns shall be reasonably required.
