Know all men by these presents that I Donald Ferguson "The Commissioner of Public Lands" for Prince Edward Island, under the authority of an Act passed in the sixteenth year of the reign of Her, present Majesty Queen Victoria, instituted An Act for the purchase of lands on behalf of the Government of Prince Edward Island, and to regulate the sale and management thereof, and for other purposes mentioned, in consideration of the sum of ------
Thirty Eight Dollars and nineteen cents of lawful current money of the said Island to me in hand paid by Owen McAleer of lot or Township No. Twenty-two (22) the receipt whereof is hereby acknowledged and also in further consideration of the sum of Thirty-four Dollars and thirty four cents to be paid with interest by the said Owen McAleer in manner, and at times specified and set forth in the memorandum thereof, on the other side hereof written and signed by the said Owen McAleer and according too the terms of the said recited act Have granted, bargained, released and confirmed and by these presents Do grant, bargain, release and confirm unto the said Owen McAleer, his heirs and assigns, All that tract, piece or parcel of Land, situate, lying and being on Lot or Township Number Twenty two (22) bounded as follow, that is to say------
Commencing at a square stake fixed on the West side of the East Line of Road, at the South boundary of land leased to Owen McAleer the Elder, thence running West fifty two chains and seventy links, thence South nine chains and fifty links; thence East to the said road, thence along the said road North nine chains and fifty links to the place of commencement, agreeable to the plan hereunto annexed and contains Fifty (50) Acres, a little more or less. Being the land mentioned and described in a certain Indenture of Lease, made the Thirty first day of March A.D 1840, between Lawrence Sullivan of the one part and Owen MacClear the younger of the other part.
As delineated on the plan of he said Lot or Township together with all and singular the rights, privileges, easements, advantages and appurtenances, whatsoever to the said land and premises belonging or in anywise appertaining, or therewith now or heretofore holden, used, and enjoyed, to have and to hold the said Tract of Land, with the appurtenances, thereunto belonging, hereby granted and released unto the said Owen McAleer his heirs and assigns, to the proper use and behoof of the said Owen McAleer, his heirs and assignsassigns to the only proper use and behoof of the said Owen McAleer his heirs and assigns forever, and to no other use, intent or purpose whatsoever, as fully, amply and beneficially as the original grantee or grantees therto; subject nevertheless, to the payments to be made in respect therof written, and to be enforced as in the said recited act set forth
