Assist RegThis Indenture made the Second day of May in the year of Our Lord One thousand eight hundred and fifty seven. Whereas John Hiscock of Lot or Township number Thirty two in the Parish of Charlotte in Queens County in Prince Edward Island farmer deceased departed this life on or about the day of in the year of Our Lord One thousand eight hundred and thirty six And Whereas the said John Hiscock was at that time of his death seized of or well and sufficiently entitled to a certain tract of land hereinafter described and set forth by virtue of a certain Indenture of Lease dated the Twentieth day of February in the year of Our Lord One thousand eight hundred and thirty and made between John Cambridge of Bristol in England Merchant of the one part and John Hiscock the Lessee of Lot or Township number Thirty two in the Parish of Charlotte in Queens County in the said Island farmer of the other part for the considerations therein mentioned Did demise unto the said John Hiscock his executors, administrators and assigns a certain tract or parcel of land thus described, that is to say commencing at a stake fixed in the west bank of the York or North River being the southeast boundary stake of a Tract of land leased to Dugald Campbell, and from thence by a line running West three degrees South (W3° S) the distance of One Hundred (100) chains, thence South three degrees East (S3° E) ten chains, thence East three degrees North (E3° N) to the shore of York or North River aforesaid , and from following the courses of the said shore northwardly to the stake or place of beginning containing by estimation One hundred acres of land a little more or less, and is part of Township number thirty two aforesaid in the Parish and County aforesaid in the said Island, To Hold to the said John Hiscock his executors, administrators and assigns for the term of Nine hundred and ninety nine years (999) from the first day of May then next ensuing at the yearly rent of one shilling sterling per acre per annum. And whereas the John Hiscock before the time of his death (he being at the time thereof in full possessions of his rational faculties and of sound mind, memory and understanding) made his last Will and Testament bearing date ______ in the year of Our Lord eight hundred and thirty six in the presence of William Cummins & Neil McKinnon subscribing Witnesses thereto, as will fully appear in the said will which said Will and Testament was duly Registered in the Office of the Judge of Probate or Office kept for the Registry of Wills and Testemants in Charlottetown in the said Island on the ninth day of May in the year of Our Lord One Thousand eight hundred and thirty six, wherein the said John Hiscock deceased did devise and will the aforesaid described One hundred Acres of Land with other things unto his wife Sarah Hiscock now Sarah Morshead for to be distributed and divided among his legally begotten children (by the said Sarah Hiscock now Sarah Morshead) when of age according as her the said Sarah Hiscock now Sarah Morshead may deam fit and to which of the hereinafter named children she might wish or desire according to her mind and will (the youngest child being now of age) And Whereas the hereinafter named children are willing and desirous each and all to relinquish and quit claim to their said mother Sarah Hiscock now Sarah Morshead and to rest her with full power as far as they the said hereinafter named children as concerned or entitled by Law of the above described One hundred Acres of Land to assign transfer and sell or demise or to make any other use or uses of whatsoever as she may think fit or require. And Whereas the said John Hiscock at the time of his death left surviving him his said wife Sarah Hiscock now Sarah Morshead and two sons and three daughters, the youngest being nine years old and the eldest years oldest all begotten in Wedlock issue legal from the bodies of the said John Hiscock deceased and the said Sarah Hiscock now Sarah Morshead. Now This Indenture Witnesseth that for and in consideration of the natural love which they the hereinafter named children have for their said mother and for and in consideration of the sum of Five shillings of lawful money of the currency of the said Island by the said Sarah Hiscock now Sarah Morshead in hand will and truly paid the receipt whereof they the children above referred to Mary Hiscock now Mary Sneeston, James Hiscock (a blind man) Sarah Hiscock now Sarah Campbell, John Hiscock and Jane Hiscock now Jane MacKinlay, Do and each of them Doth hereby acknowledge, acquit and discharge the said Sarah Hiscock now Sarah Morshead her heirs and assigns forever by these presents, they the said Mary Hiscock now Mary Sneeston and the said William Sneeston her husband, James Hiscock (a blind man) Sarah Hiscock now Sarah Campbell and the said Robert Campbell her husband, John Hiscock and Jane Hiscock now Jane MacKinlay and the said Allan MacKinlay her husband Have and each of them severally Hathe granted, bargained, sold, assigned, transferred and made over, and quit claimed, and by these presents Do and each and every of them Doth grant, bargain, sell, assign, transfer and make over, and quit claim unto the said Sarah Hiscock now Sarah Morshead, her executors, administrators and assigns All that Tract, piece or parcel hereinbefore described and mentioned, and hereby assigned and transferred or intended so to be, situate, lying and being part of Township number Thirty two aforesaid in the Parish and County aforesaid in the said Island, commencing at a stake fixed on the west bank of the York or North River being the southeast boundary stake of a Tract of land leased to Dugald Campbell and from thence by a line running West three degrees South (W3° S) the distance of One Hundred (100) chains thence South three degrees East (S3° E) ten chains, thence East three degrees North (E3° N) to the shore of York or North River aforesaid , and from thence following the courses of the said shore northwardly to the stake or place of beginning, containing by estimation One hundred acres of land, a little more or less and is part of Township number thirty two aforesaid in the Parish and County aforesaid in the said Island or all that tract of land contained in the in part recited Indenture of Lease Together with all and singular the house, yards, gardens, trees, woods, underwoods, ways, waters, watercourses, profits, commodities, hereditaments and appurtenances And all the said Estate, right, title, interest, property, possession, claim and demand whatsoever, both at Law and in Equity of them the said Mary Hiscock now Mary Sneeston and William Sneeston her husband, James Hiscock (blind man) Sarah Hiscock now Sarah Campbell and Robert Campbell her husband, John Hiscock and Jane Hiscock now Jane MacKinlay and Allan MacKinlay her husband, their or either of their heirs, executors, administrators or assigns, To Hold unto her the said Sarah Hiscock now Sarah Morshead, her executors, administrators or assigns for and during all the rest residue and remainder of the term of years mentioned in the in part recited Indenture of Lease yet to come and unexpired, Subject Nevertheless to payment of all rents and the fulfilling of each and all covenants and condition and terms mentioned and contained in the in part recited Indenture of Lease reserved and contained and which or the part of the Lessee or assignee are or ought to be paid, kept, done and performed And it is understood by the said parties to these presents that should the said Sarah Hiscock now Sarah Morshead, at any time hereafter want any further assignments or assurances in the Law, for the better, more perfectly and absolutely, assigning, transferring or making over the said premises hereinbefore described, and the said Sarah Hiscock now Sarah Morshead, her heirs and assigns, that they the said Mary Hiscock now Mary Sneeston and William Sneeston her husband, James Hiscock (a blind man) Sarah Hiscock now Sarah Campbell and Robert Campbell her husband, John Hiscock and Jane Hiscock now Jane MacKinlay and Allan MacKinlay her husband their or each or either of their heirs and assigns, make, do and execute, or cause or procure to be made, done and executed, all and every such further and other lawful and reasonable act and acts, thing and things, assignments and transfers that may be at any time required. In Witness Whereof the said parties to these presents have and each of them hathe hereunto set their and each of their hands and seals the day and year first above written.
