The maps, documents and 1861 PEI census referred hereafter often spell the surname "Guard", occasional "Garde" but we have used "Gard" in our narrative about them.
Peter Burd Gard ( hereinafter Peter senior) executed a lease for 53 acres more or less, in Lot 5, Prince County, with Edward Cunard junior of Halifax on June 20, 1848, for a term of 999 years commencing the 25th day of March 1848. The lease excluded "all timber and other trees fit for square timber, masts, shipbuilding, or saw logs, now growing or being or shall grow upon the premises"2. The lease terms were "a hopper of corn for the first two years of the said term, then yearly rent or sum of three pence sterling per acre for and during the next two years of the said term, the yearly rent or sum of six pence sterling per acre for and during the next two years of the said tem, the rent or sum of nine pence sterling per acre for the next year of the said term, and the yearly rent or sum of one shilling sterling peracre for and during the remainder of the said term"3 payable on the 25th of March yearly commencing the 25th of March 1851.
The "1848 Plan" on the lease shows four adjacent lots West to East:
1. identified as "George Shaw" Peter senior’s brother-in-law (hereinafter "Lot i");
2. identified as "Peter Guard 53 acres" (hereinafter "Lot ii") which Peter senior acquired by the "1848 Lease";
3. identified as "Peter Gard" (hereinafter "Lot iii’) which Peter senior acquired prior to 1848;
4. identified as "John [illegible] (hereinafter "Lot iv") which he acquired sometime before 1851.
In 1851 Peter senior transferred "Lot ii" on the "1848 Plan" to his son, Samuel and the most easterly "Lot iv" on "1848 Plan" to his son, Peter Gard (hereinafter referred to as "Peter junior"), for the sum of £ 10 each. Samuel Gard (1828-1873), eldest son, and our forbearer, married Elizabeth
Wellsford Metherall (1828-1870) about 1854. She was the daughter of Thomas and Ann (Crue or Carew) Metherall, and sister to Thomas Metherall who married Samuel’s older sister, Jane Gard. In 1851, Samuel assumed the lease for "Lot ii", 53-acres, from his father as shown on the "1848 Plan", situated between his Uncle George Shaw ("Lot I") on the west and his brother
Peter Junior on the east. Peter Gard (1830-1923) (hereinafter referred to as "Peter junior") second son and namesake of Peter Burd or Peter Burd Gard, married Isabella Hardy (1832-1902) on Thursday, February 1, 1855. She was the daughter of Robert and Flora Hardy. Peter junior assumed the lease on most easterly 50 acres
"Lot iv" as depicted on the "1848 Plan" on Mill River situated to the west of his Uncle George Shaw ("Lot i"), father, Peter senior ("Lot iii") and brother, Samuel ("Lot ii") , and adjacent to Samuel’s parcel.
"Lot i" lessee, George Shaw, was Margaret (Shaw) Gard (Peter Burd Gard’s wife’s) half-brother, and he transferred "Lot i" to his nephew William on Monday the 28th of April 1856. George Shaw originally leased it by a lease dated Jun 20, 1848.
Peter Senior, referred to as "Peter Gard the elder" in the document, executed a lease for 84 acres (hereinafter "Lot v"), more or less, on October 27, 1856 from Edward Cunard for a term of 999 years with the same timber exception of the earlier lease. The payment terms are illegible in the copy held except it rose to one shilling sterling as did the below lease and was payable on the 25th of March yearly commencing 25th of March 1857.
The "1856 Plan" shown on the "1856 lease" shows the location of the land bordering on Long Creek.
A map date unclear but appears to be 1859, identifies;
1. "Lot i" as "George Shaw William Gard";
2. "Lot ii" as "Peter Gard (now Samuel)" which matches the "1848 Plan";
3. "Lot iii" is identified as "Peter Gard". likely be the location of the original homestead of Peter Senior and Margaret circa 1830;
4. "Lot iv" is identified "Peter Gard" with "John" below, who would be his son;
5. "lot v", the 84-acre Parcel which matches the "1856 Plan" on the "1856 lease".
William Gard is also shown as lessee of 57 acres directly adjacent to Peter Senior’s "Lot v".
The lease for "Lot iii" on the "1848 Plan" was transferred to George Gard by his father, Peter Senior by an Agreement signed on May 12, 1860, registered at the Registry Office 11 October 1861. George paid £ 10 plus 10/-. He died in 1862. "Lot iii" was split evenly between Samuel and Peter Junior after George’s death in 1862 but before Samuel’s sudden death at age 26 in 1873.
The 1861 census dated January 14th listed land leases, acreage leased, term of lease, years expired, and annual rent. No leases are shown for Peter Senior indicating he had bought out or transferred all his leases.
1. "Lot i" William is listed with a 999-year lease for 51 acres; 4 years expired at 1/- per acre, per year. That would make it the "lot i" originally owned and transferred from his Uncle George Shaw in 1856.
2. "lot ii" Samuel is shown with 53 and 27 acres leased (total 80 ac) on a 999-yr term, 8 years expired at 1/- per acre, per year.
3. "lot iv" Peter Junior is shown as having a 999-year lease on 50 and 27 acres (total 77 acres), 8 years expired at 1/- per acre, per year.
4. "Lot iii" The middle 50-ac Parcel owned by Peter Senior on "1848 Plan" and "1859 map" and that was to have gone to George was severed into two 27-acre parcels.
John Gard (1840-1924), 26, married Maryann Dignan (1845-1920), 21, the daughter of John and Sarah (Heaney) Dignan, in 1866. The "1882 Map" shows John occupied and farmed 52 acres adjacent to his father. That 52-acre parcel of land was sold in 1901 to his nephew, Albert - son of Samuel and Elizabeth (Metherall) Gard - and it was farmed for a short time by his son Frank until sold to Arthur Martin and then to James Rooney.
On the ‘1882 Map" "Lot ii", being 53 acres, Lot iii", being 50 acres and "Lot iv", being 54 acres, all more or less, are now listed as 80 acres to "Heirs of Samuel Guard" and 77 acres to Peter Junior, a total of 157 acres.
This confirms that "Lot iii", being 50-acres more or less was split between Samuel and Peter Junior and was found to be 54 acres on severance. Samuel Gard died in 1873 and the land sale to Dickerson in 1881 are 8 years apart.
The 50-acre "Lot i" previously listed as "George Shaw William Gard" on "1859 Map" is now listed as William Gard alone. William Gard is still shown as having the 57-acre Parcel as on the "1859 Map".
The "1859 Map" had a vacant wedge backing on the 3 adjacent to Lots "i", "ii". "iii" and "iv". It would appear, if the "1882 Map" is being read correctly, that from that vacant parcel Wm Gard acquired 38 acres, Samuel Gard, 57 acres and Peter Gard Junior, 45 acres.
By a hand-written agreement dated March 9, 1871 and attached to a sale agreement dated November 18, 1872 and the deeds apparently not registered until March 14 1881, Peter sold "to my beloved son John Guard (sic) all that piece or parcel of land now occupied by him on the west side of the old (unknown) Gard Farm containing about fifty-two (52) acres…" and also the north half of the (Long) Creek Farm containing about forty-three (43) acres…." for three hundred Dollars. John subsequently sold the north half of the Long Creek Farm "containing Forty (40) acres of land a little more or less" to William Dickerson for $200 by a hand-written sales agreement dated March 8, 1881 deposited and registered with "Province of P.E, Island Crown and Public Land Dept." March 8, 1881.
The 84-acre parcel is now a 38- and 46-acre parcel with the 38 acres in William Dickerson’s name and no name listed for the 46 acres. Meanwhile, a 184 acre parcel on Mill River listed to James Yeo in the "1859 Map" is now listed as 103 acres under Peter senior and 52 acres, John Gard. So Peter has sold the 84 acre parcel and acquired a 155 acre parcel from James Yeo.
In summary:
1) circa 1859, Peter Burd Gard leased/owned 4 parcels – "Lot v", 84 acres; "Lot ii" 53 acres; "Lot iii" 50 acres and an adjacent "Lot iv", 54 acres, whose acreage can be deduced from information on the circa 1882 map. William Gard had 57 acres in his own right plus "Lot I", 50 acres, with his Uncle George Shaw.
2) Census of 1861, Samuel had 80 acres leased and Peter Junior had 77 acres leased which was the 3 parcels (Lots ii, iii, iv) formerly leased by their father, and William had 51 acres leased, transferred from his Uncle. William must have retired his lease on the 57 acre Parcel by 1861 as this parcel is not listed as leased.
3) Circa 1882, Peter Senior and John Gard held 155 acres; Wm Gard had 145 acres in 3 parcels of 50 acres ("Lot I"), 57 acres and 38 acres.; the Heirs of Samuel Gard had 137 acres in two parcels of 80 acres (Lot ii & half Lot iii) .plus 57 acres; and Peter Junior had 122 acres in two parcels of 77 acres (Lot iv & half Lot iii) and 45 acres

containing Ninety-one acres of Land, a little more or less, also I do hereby relinquish all claim or right , whatsoever thereto, and I do hereby establish and confirm the said John Grade in full possession of the same, and do hereby fully authorize and empower the Commissioner of Public Lands to accept of the said John Garde as the purchaser of the fee simple of the said premises, and to execute and issue a conveyance of the said premises to the said John Garde his Heirs or Assigns, he or they complying with the provisions of the Law in that case made and provided.

Know all men by these Presents that the within names lessee Peter Guard the Elder in consideration of the Sum of ten pounds of lawful current money of Prince Edward Island justly due and owing from the Said Peter Guard to George Guard of the Parish of Egmont in Prince County Shipwright and also the sum of ten shillings to him the said Peter Guard in hand paid by the said George Guard at or immediately before the ensealing (sic) and delivery of these Presents Hath granted, bargained,, sold, transferred and set over and by these Presents Doth, bargain, sell, transfer and set over with the said George Guard the within mentioned land leases(?) Land(?) Mortgages(?) or easements and premises(?) with the Appurtenances
As also this Indenture of Lease. YIELDING AND PAYING therefore Yearly and every year during the said Term hereby granted, unto the said edward cunard, jun,, his Heirs, Appointees and Assigns the clear Yearly Rent or Sum of a hopper(?) corn for the first two years of the said term, the yearly rent or sum of three pence sterling per acre for and during the next two years of the said term, the yearly rent or sum of six pence sterling per acre for and during the next two years of the said term, the yearly rent or sum of nine pence sterling per acre for and during the next year of the said term, and the yearly rent or sum of one shilling sterling per acre for and during the remainder of the said term without making any deduction or abatement whatever, for or in respect of any present or future Quit Rents, Land Taxes, or other Parliamentary, Colonial or Parochial Taes, Assessments, Payments or Impositions whatsoever, by Yearly Payments, on the twenty-fifth day of March in every year; the first payment thereof to become due and be made on the twenty-fifth day of March 1851 next ensuing the date of these presents. AND the said Peter Guard doth for himself, Executors, Administrators and Assigns, covenant, promise and agree, with and to the said edward cunard, jun,, his Heirs, Appointees and Assigns, in manner following, that as to say that he ,the said Peter Guard his Executors, Administrators and Assigns, shall and will , from time to time, and at all times during the continuance of the term hereby granted, well and truly pay, or cause to be paid unto the said edward cunard, jun,, his Heirs, Appointees and Assigns,, the said Yearly Rent hereby reserved, upon the days and times, and in the manner hereinbefore mentioned for the payment of the same according to the true intent and meaning of these presents. AND ALSO , that he, the said Peter Guard his Executors, Administrators and Assigns, shall and will pay, satisfy and discharge, cause to be paid, satisfied and discharged, all and all manner of Quit Rents, Land Taxes, and other Parliamentary, Colonial or Parochial Taxes, Rates, ,Assessments, Payments or Impositions whatsoever, now or at anytime hereafter, during the said term hereby demised, payable for or in respect of the said premises, or any part of them, or the said Yearly Rent, or any part thereof. AND ALSO, that he, the said Peter Guard his Executors, Administrators and Assigns shall not or will, at any time or times hereafter, without the consent in writing of the said edward cunard, jun,, his Heirs, Appointees and Assigns, sell or dispose of any Timber and Trees fit for square Timber, Masts, Ship-building, or Saw-logs, cut upon the said premises, or any part thereof. PROVIDED ALWAYS, NEVERTHELESS, and these premises are upon he express condition, that if the said Yearly Rent hereinbefore reserved, or any part thereof, shall be in arrears for the space of Twenty-one days next after the same ought to have been paid as aforesaid, (being lawfully demanded) that then and in every such case, and at all times hereafter, it shall and may be lawful to and for the said edward cunard, jun,, his Heirs, Appointees and Assigns, into the said premises hereinbefore demised, or into any part thereof, in the name of the whole, wholly to re-enter, and the same to have again, re-posses and enjoy, as in his or their former Estate, anything hereinbefore contained to the contrary thereof in anywise notwithstanding. AND the said edward cunard, jun,, his Heirs, Appointees and Assigns, covenant, promise and agree with and to the said Peter Guard his Executors, Administrators and Assigns, in manner following, that is to say that he the said edward cunard, jun,, his Heirs, Appointees and Assign, shall from time to time, and at all times during this present Lease, allow and permit the said Peter Guard his Executors, Administrators and Assigns, to cut and take Timber and Wood of and from the hereby demised premise, (if any such there be) for necessary fuel for Firing, and also for erecting Buildings, repairing Fences, and implements of Husbandry, and for all Farming purposes whatsoever; and also to sell and dispose of Firewood and Longers. AND ALSO, that it shall and may be lawful to and for the said Peter Guard his Executors, Administrators and Assigns, (paying the Rents hereinbefore reserved,, and performing the covenants and agreements hereinbefore mentioned or contained, and which on his or their parts and behalf are or ought to be paid, done and performed) subject nevertheless as aforesaid, peaceably and quietly to have, hold, occupy, possess and enjoy the hereby leased premises, with all the Appurtenances, during the said term hereby granted without the lawful let, suit, ,trouble, denial, eviction, ejection, ,interruption or disturbance whatsoever of, from or by the said edward cunard, jun,, his Heirs, Appointees and Assigns, or of, from or by any other person or persons lawfully claiming or to claim the said hereby demised premises, or any part or parcel thereof.
