Edward Island by the said Donald Wares to the said David Stuart Rennie in hand well and truly paid the receipt whereof is hereby acknowledged They the said David Stuart Rennie and Susan his wife Have and each of them Hath granted bargained sold aliened released and confirmed and by these presents Do and each of them Doth grant bargain sell alien release and confirm unto the said Donald Wares his heirs and assigns All that tract piece or parcel of land situate lying and being on Township Number Twenty three in Greenville Parish in Queens County Prince Edward Island and is bounded as follows commencing at a stake on the Northeastern side of the Road leading from Charlottetown to Prince Town and on the North western side of the road leading to the Bungay Settlement it runs thence along the North western side of said last named road as far as the south east corner of land leased to Angus Macdonald (being at the angle where said road turns to the north) thence along the south western boundary of said Angus Macdonalds land twenty chains and twenty links or to the southeast corner of land leased to Alexander Macdonald thence along the boundary of said land Southwest to the said Road leading from Charlottetown to Prince Town then along the said road to the place of commencement having a breadth of twenty chains containing by estimation one hundred acres a little more or less being part of Township Number Twenty three aforesaid Together with all and singular the houses yards gardens meadows marshes fences trees woods underwoods ways waters watercourses paths passages profits commodities hereditaments and appurtenances whatsoever to the said piece or parcel of land belonging or in anywise appertaining And the reversion and reversions remainder and remainders rents issues and profits thereof And also all the Estate right title interest Dower or right of Dower use trust property claim and demand whatsoever both at Law and in equity of them the said David Stuart Rennie and Susan his wife of in and to the same and every part and parcel thereof To have to hold the said pieces or parcels of Ground and premises with the hereditaments and appurtenances herein before mentioned and described unto the said Donald Wares his heirs and Assigns forever Subject nevertheless to the payment of the Quit Rent hereafter to grow due and payable to her Majesty her heirs and Successors in respect of the land hereby granted and released and to all other public burdens already imposed or to be imposed on the said premises and every part thereof and to the conditions and reservations of the Original Grant from the Crown of said Township Twenty three And the said David Stuart Rennie and Susan his wife for themselves their heirs executors and Administrators do hereby covenant promise and agree to and with the said Donald Wares his heirs and Assigns in manner following that is to say that now at the time of the ensealing of these presents He the said David Stuart Rennie not withstanding any Act done or suffered by him or any person claiming under him is lawfully and rightfully seised of the leases and premises mentioned to be hereby granted and released with their and every of their Appurtenances of and in a pure perfect absolute and indefeasible Estate of Inheritance in fee simple without any manner of condition contingent proviso power of limitation or revocation of any use or uses or any other restraint matter or thing whatsoever to alter change determine abridge defeat encumber revoke or make void the same And also that he the said David Stuart Rennie not withstanding any such act done suffered as aforesaid now hath in himself good right full power and absolute Authority to grant bargain sell alien release and assure the said premises with their Appurtenances unto the said Donald Wares his heirs and Assigns in manner aforesaid according to the true intent and meaning of these presents And further that he the said Donald Wares his heirs and Assigns shall and may from time to time and at all times hereafter peaceably and quietly have hold use occupy possess and enjoy the said lands tenements hereditaments and premises mentioned to be hereby granted and released with the appurtenances without the lawful let suit trouble molestation interruption or denial of them the said David Stuart Rennie and Susan his wife their heirs executors or Administrators or any other person or persons whomsoever lawfully claiming or to claim the same by from or under him her them or any of them And that free and clear and freely and clearly exonerated acquitted and discharged of from and against all and all manner of former and other gifts grants bargains sales leases jointures dowers uses wills entails judgments executions extents titles trouble charges and incumbrances whatsoever has made done suffered committed or defending<<?>> by them the said David Stuart Rennie and his heirs and all and every other person and persons whomsoever having or lawfully claiming or who shall or may hereafter have or lawfully claim any Estate right title interest or property of in or to the said premises mentioned to be hereby granted and released<<?>> or any part thereof shall and will from time to time and at all times hereafter upon the reasonable request and at the proper cost and charges in the Law of the said Donald Wares his heirs and assigns make do and execute or cause and procure to be made done and executed all and every such further and other lawful and reasonable Act and Acts thing and things devises deeds conveyances and assurances in the law whatsoever for the further better more perfectly and absolutely granting conveying and assuring the said premises with their and every of their appurtenances unto the said Donald Wares his heirs and assigns as by the said Donald Wares his heirs and Assigns or his or their counsel learned in Law shall be reasonably devised or advised and required. In Witness whereof the said Parties to these presents have hereunto set their hands and seals the day and year first above written the said Susan Rennie having affixed her hand and seal by Robert Rennie her attorney in virtue of a Power of Attorney for that purpose duly executed and registered

This Indenture made the second day of June in the year of our Lord one thousand eight hundred and Fifty nine in pursuance of an Act made and passed in the twelfth year of the reign of Our Sovereign Queen Victoria entitled An Act for rendering a Release as effectual for the conveyance of Freehold Estates as a Lease and Release by the same parties Between David Stuart Rennie of No. 2 Saint Marys place Brompton in the County of Middlesex Esquire and Susan his wife by Robert Rennie his Attorney duly authorized as herein after mentioned of the one part and Donald Wares of Township Number Twenty three in Prince Edward Island farmer of the other part Witnesseth that for and in consideration of the sum of Seventy four pounds one shilling and six pence of lawful current money of Prince

I Antony Borolby clerk to Mr. James Crowdy of No. 17 Sergeant Inn in the City of London Solicitor do Solemnly and sincerely declare that the said James Crowdy and I the said declarant were together personally present and did see David Stuart Rennie party to and named and described in the Indenture or Deed of Conveyance hereunto annexed Sign and seal and as and for his act and deed deliver<<?>> the said Indenture or Deed of Conveyance and did also see the said David Stuart Rennie sign the receipt endorsed on the said Indenture or Deed of Conveyance and that the names or signatures "D.S. Rennie" set and subscribed to the said Indenture or Deed of Conveyance as that of one of the parties executing the same and also to the said receipt are of and in the proper handwriting of the said David Stuart Rennie and that the name or signatures "Jas Crowdy Anthony Borolly" Set and Subscribed to the said Indenture or Deed of Conveyance as those of the witnesses to the execution thereof by the said David Stuart Rennie and also to the signing of the said receipt by the said David Stuart Rennie are of and in the proper and respective handwriting of the said James Crowdy and myself the said Declarant and I make this Solemn Declaration conscientiously believing the same to be true and by virtue of the provisions of an Act made and passed in the sixth year of the reign of His Majesty King William the fourth entitled "An Act to repeal an Act of the present Session of Parliament entitled An Act for the more effectual abolition of Oaths and Affirmations taken and made in various departments of the State and to substitute Declarations in lieu thereof and for the entire suppression of voluntary and extrajudicial oaths and Affidavits and to make other provisions for the abolition of unnecessary oaths"
