The Last Will and Testament of Thomas McGuigan ( - 1913, Lot 22)

This is the last will and testament of me Thomas W. McGuigan of Lincoln, Lot 22, Queen's County, Prince Edward Island, farmer. I hereby revoke all former wills and declare this to be my last will and testament. I hereby appoint James McAleer of Lincoln, Lot 22 aforesaid farmer and Alexis A. Murphy of St.. Ann's Lot 22, farmer, executors of this my last will and testament.

I appoint and will that my just debts, funeral expenses and the sums hereafter devised for masses be paid as soon as possible. I hereby empower and appoint my executors to sell either by public auction or by private sale, within twelve months from the day of my death, my farm property on which I now reside in Lincoln, Lot 22 containing 100 acres of land, a little more or less, also to sell the stock, crop and my interest in the farming implements of which I die possessed.

I leave in the hands of my executors the sum of One Hundred Dollars ($100.00) to have High Masses said for the repose of my soul. I also leave in the hands of my executors the sum of Fifty Dollars ($50.00) to have High Masses said for the repose of the soul of my late father and other deceased members of my family. I appoint my executors to procure and pay for, out of my estate, a tombstone or monument to stand at my head and not to exceed in price the sum of Fifty Dollars ( $50.00)

I leave to the building fund of St. Ann's Catholic Church, St. Ann's Lot 22, the sum of Twenty-Five Dollars($25.00).

I leave my gold watch to my beloved son James Patrick McGuigan.

I appoint my beloved wife Charlotte Henrietta McGuigan sole guardian of my beloved children James Patrick McGuigan and Lilian McGuigan until they come of lawful age.

To my beloved wife Charlotte Henrietta McGuigan, I will Six Hundred Dollars ( $600.00) to be paid her out of my estate as soon as possible after the disposal of my property, as full quittance in lieu of her dowery.

To my beloved daughter Lilian McGuigan I will Six Hundred Dollars ($600.00) to be deposited by my executors in a chartered bank, subject to their disposal until my aforesaid daughter Lilian McGuigan comes of lawful age, when the said amount becomes her property.

To my beloved son James Patrick McGuigan I will Eight Hundred Dollars ($800.00) to be deposited by my executors in a chartered bank, subject to their disposal until my aforesaid son James Patrick McGuigan comes of lawful age, when the said amount becomes his property.

I will that the yearly interest on the bequests to my beloved children namely the interest on Six Hundred Dollars ($600.00) also the interest on Eight Hundred Dollars ( $800.00) be paid each and every year to my beloved wife until said children shall come of lawful age.

I appoint and hereby empower my executors to receive my Insurance Five Hundred Dollars ( $500.00) from the Catholic Mutual Benefit Association of Canada Policy No. 2030, branch No. 338 and place the said Insurance to the credit of my estate.

Finally, I appoint that all monies remaining in the hands of my executors after paying my just debts, funeral expenses and various bequests shall be divided equally between my beloved wife Charlotte Henrietta McGuigan and my beloved children Lilian McGuigan and James Patrick McGuigan and each share placed to the credit of each in a chartered bank.

In testimony whereof I have hereunto set my hand this third day of February Nineteen Hundred and Thirteen A.D. 1913.

This will was proved on the 31st day of March, A.D. 1913 on the Oath of James A. McGuigan, one of the subscribing witnesses thereto and was filed and registered on the 31st day of March A.D> 1913 and Probate granted on the same day to the executors therein named.

Note: Thomas McGuigan died March 27, 1913 at age 41. His wife was Charlotte Henrietta McKenna who was born March 21, 1880 and died September 21, 1863. Both are buried at St. Ann's, PEIGS Cemetery Transcript ref # 25. -- W. Stimson Jan 14, 2001
