Will of Thomas Davy of Charlottetown (1813-1875)


THE LAST WILL AND TESTAMENT OF THOMAS DAVY
c. 1813- 21 May 1875

In the name of God Amen. I Thomas Davy of Charlottetown, Blacksmith do hereby make my last will and testament. I desire that all my just debts funeral and testamentary expenses be fully paid by my Executors herein after mentioned.

I give devise and bequeath unto my wife Dorothy Davy and all my free hold property to lands and tenements to hold the same for the term of her natural life and after her death to my present children share and share alike as tenants in common provided always and I hereby declare my will to be that in case my said wife should bona fide incur debts in endeavouring to support and maintain herself that then and in such case she should have full power and authority absolutely to sell and and dispose of so much of my said real estate as shall realize a sum sufficient to enable her to pay off such debts as incurred by her as aforesaid I give and bequeath unto my said wife any household furniture to be used and enjoyed by her for the term of her life and after her death to my three daughters in equal shares. I hereby appoint Doctor Richard Johnston and James Hudson, Executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this nineteenth day of November in the year of our Lord, One Thousand eight hundred and seventy four.

Signed sealed published and declared by the Testator for his last will and testament in the presence of us who in his presence and in the presence of each other have subscribed our names as witnesses

This is a codicil to my will I give my tools of my trade, my book debts and all whatever property I may die possessed of not heretofore or in my said will disposed of to my said wife absolutely dated 19 November 1874

The above will and codicil were proved on the 26 of May 1875 on the oath of Francis J. Conroy as subscribing witness thereto respectively and on the same date Probate was granted to the Executor
