The Last Will and Testament of John Richard Botts Jr. (1831 - 1884 , Bloomfield)
This is the last will and testament of me, John Richard Botts, of Bloomfield in Prince County, Province of Prince Edward Island, farmer. My will is first that my just debts be paid by my executors hereinafter named, And that the sum of thirty dollars be also paid by them to the Priest cure of the said parish of Bloomfield to be appropriated by him in accordance with the custom of the Roman Catholic Church and the residue and reminder of my real and person property which shall not be required for such purpose I give, devise and dispose thereof as follows to wit;
I give and devise to my beloved wife, Delphine Gallant Botts, a portion of the farm on which I will reside, which said piece or parcel of land will commence at the Southwest angle of the said farm thence along the western line of said farm to the rear, and running eastwardly along front and rear boundaries a sufficient distance to contain fifty acres, to have and to hold to her and her heirs, executors and dministrators to her and their use and behalf forever. I also give and bequeath to the said Delphine Botts my beloved wife, one horse, one cow and ten sheep to have and to hold to her own use and benefit and to the use and benefit of her heirs, executors and administrators. I moreover bequeath to my beloved wife, Delphine Botts, the entire exclusive and undivided use of my dwelling house where I now reside to have and to hold the same for her, her heirs, executors and administrators.
I give, devise and bequeath to my friend, John Peters, in token of my friendship for him three-fourths of an acre of land being a portion of my farm aforesaid, the said three-fourths of an acre to include the site of the house in which he now resides together with a right of way to and from the said piece or parcel of land to the highway for free ingress and egress of foot passengers, horses, carriages and things whatsoever at any and all times to have and to hold the same to his use and benefit and the use and benefit of his wife, Margaret Peters, during the term of his and her natural life.
I give, devise and bequeath to my son, Lawrence Botts, one half of the remainder of my farm, which said piece or parcel of land shall include the site on which my barns, and other outbuildings are now erected, to have and to hold the same to him, his heirs, executors and administrators to his and their use forever.
I give, devise and bequeath to my son, David Botts, the remaining portion of my farm to have and to hold to him, his heirs, executors and administrators to his and their use forever.
I give and bequeath to my daughter, Amelia McDonald, the sum of twenty-five dollars in cash to be paid her by my executors hereinafter named within five years after my decease.
I give and bequeath to my daughter, Angeline Arseneau, also the sum of twenty-five dollars in cash to be paid her by my executors, hereinafter named in four years after my decease.
I give and bequeath to my daughters, Caroline Botts, Annie Botts, Mary Botts, and Emmeline Botts the sum of twenty-five dollars each to be paid them by my executors when and as such time as each of them shall become of the age of twenty one years to have and to hold to them the said Amelia Mc Donald, Angeline Arseneau, Caroline Botts, Annie Botts, and Emmeline Botts, their heirs, executors and administrators and assigns forever to their use and behalf and to the use and behalf of their heirs, executors, administrators and assigns forever.
I give and bequeath to my daughter, Angeline Arseneau, one cow and three sheep to be delivered her by my executors hereinafter named when she demands the same to have and to hold the same to her and her heirs, executors, administrators and assigns forever to her and their use and behalf forever.
I give and bequeath to my daughters, Winnifred and Florentine Botts, the sum of fifty dollars each to be paid them by my executors hereinafter named when they become of the age of twenty-one years to have and to hold the same to them and their heirs, executors, administrators and assigns to their use and behalf and to the use and behalf of their heirs, executors, administrators and assigns forever.
I also give and bequeath to my daughters the said Caroline Botts, Annie Botts, Mary Botts, Emmeline Botts, Winnifred Botts and Florentine Botts, as will become married one cow and three sheep each, to be given them by my executors hereinafter named immediately after their marriage to have and to hold the same to them and their heirs, executors, administrators and assigns and to their use and behalf forever.
I also give and bequeath to my daughters, Mary Botts, Emmeline Botts, Winnifred Botts and Florentine Botts, a sum sufficient to pay for their education at the Convent in Tignish in County and Province aforesaid for the term of three years each which said sum will be paid by my executors hereinafter named for them and to their use and benefit.
I give and bequeath all the rest and residue of my estate, real, personal and mixed of which I shall be seized and possessed or to which I shall be entitled at the time of my decease to my two sons, Lawrence Botts and David Botts, aforesaid to have and to hold the same to them and to their heirs, executors, administrators and assigns and to their use and behalf and to the use and behalf of their heirs, executors, administrators and assigns forever.
And I do nominate and appoint the Reverend, FelixVon Blerk cure of the Parish of Bloomfield my beloved wife, Delphine Botts, aforesaid and Fabian Peters of O'Halloran Road, all of Prince County and Province aforesaid to be the executors of this my last will and testament.
In testimony whereof I the testator have hereunto set my hand this thirtieth day of October in the Year of Our Lord One Thousand eight hundred and eighty-four. (1884)
