The annexed Will of James Gordon late of Appin Road in Queen’s County in Prince Edward Island, farmer being presented for Probate Gilbert Gaudet of Charlottetown in Queen’s County, Barrister-at-law one of the subscribing witnesses thereto make oath that he was present and did see the said testator and deliver the same and also heard him publish and declare the same as and for his last Will and testament and that when he the said testator so did he was of sound disposing mind and memory according to this deponent’s best discerning and that he this deponent set and subscribed his name as a witness thereto in the testator’s presence and that
Justin M. Hynes of Charlottetown set and subscribed his name as a witness thereto at same time.

Judge of ProbateThis is the last will and testament of me James Gordon of Appin Road in Queen’s County, farmer
I give and devise to my son John Gordon five acres of land on which his dwelling and barn are now located, said five acres to leave a width of five chains on the Appin Road and to extend westerly ten chains .
I give and devise the residue of my real estate containing one hundred and forty-five acres to my son Donald B. Gordon.
I also give devise and bequeath to my said son Donald B. Gordon all my farm stock, farming implements, crop, household furniture and personal property whatsoever, to which I shall be entitled at the time of my decease.
The foregoing devise and bequeath to my son Donald B. Gordon are to be subject to the support and maintenance of my beloved wife Annie Gordon, to whom I bequeath a home and her living from my homestead and personal estate during her natural life.
Should my said wife decide to live elsewhere than on my said homestead, she shall be at liberty to do so, and in that case my said son Donald B. Gordon shall pay to her the yearly sum of Fifty Dollars in two equal halves yearly ??????? and I hereby declare that the payment of said sum of Fifty Dollars yearly to my said wife shall be a lien and charge on my said homestead farm devised to Donald B. Gordon herein.
I appoint my said son Donald B. Gordon to be the executor of this my last will and testament.
I revoke all former wills heretofore made by me and declare these bequests only to be and contain my last will and testament.
As witness my hand this Twenty-first day of December A.D. 1915.

In re estate of James Gordon, late of Appin Road in Queen’s
County, Farmer, Deceased, Testate.I, Donald B. Gordon of Appin Road in Queen’s County, Province of Prince Edward Island, Farmer, make oath and say:
1. That the above named James Gordon departed this life at Appin Road aforesaid on the Twenty-ninth day of November A.D. 1925 having first made and published his last will and testament in writing now on file in this Honourable Court.
2. That the said James Gordon was seised and possessed of real and personal property at the time of his death, the particulars of which are set forth in the Inventory of his estate hereto annexed and the said deceased had no other estate to the best of my knowledge, information and belief.
3. That under the terms of the last will and testament of the said Deceased, the whole estate will devolve upon this Deponent a son and John Gordon of Appin Road aforesaid, also a son of the said Deceased, and Annie Gordon of Appin Road aforesaid widow of the said Deceased, all of whom are of the full age of Twenty-one years.
