LAST WILL AND TESTAMENT OF FIDELE PAQUET (Liber 7 Folio 160 P.E.I.)

In the name of God, Amen, I Fedelle Potchet of Souris, in Prince Edward Island being sick & weak in body and of perfect mind and memory of my body and knowing that it is appointed for all men once to die do make and ordaine this my last will and testament that is to say principally and first of all I give and commend my soul unto the hand of almighty God that gave it, and my body I commend to the Earth, to be buried in decent Christian burial, at the discretions of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form.
First, I give and bequeath to Joseph Potchet fifty feet square of land, Edward Potchet sixty feet by forty-six of land, Michael Potchet one hundred and fifty by two hundred feet of land, Alex Potchet one hundred and forty by two hundred feet of land , Marshel Potchet one hundred by fifty five feet of land, Mary Potchet & son one hundred & forty by one hundred & twenty feet land. Jane Potchet one hundred by two hundred feet of land. Anastace & Le(?) fifty feet by fifty of land and Joseph Potchet, Sapelang Patchets son, to have ten chains long by one bound on the north side of the farm startin from cross roads west along the line.
This I likewise constitute, make, and ordain, Rev. Donald McDonald the sole executor of this my last will and testament all and singular my land, messages and tenements. And I do hereby utterly disallow, revoke and disannull all and every other former testaments, wills, legacies, bequests, and executors by me in any wise before named will and bequeathed rectifying and confirming this and no other to be my last will and testament, I witness whereof I have hereunto set my hand and seal, this twenty day of May in the year of our Lord one thousand eight hundred and fifty three.

Codicil to previous will
Situation of lots acording to my will I give and bequeath to Mary and William Paquet that piece situated between Phillip Simpsons lot and the piece owned by Mr. Donald Beaton to go as far back as to be paralell with Simpsons rear line. And to Edward Paquet the lot bounded on the west side by the lot now in possession of James McLauchlin and on the south by the main road containing 70 feet square nearly and to Marshal Paquet the lot in a three square position between Edward Paquet on the west side 65 and Alex Campion on the N. East side 65 feet and on the line road 30 feet and on the south road 35 feet and the lot bounded on the west by Alex Campion this piece formerly in possession of Donald Steele, Blk smith containing 100 feet square and unto Alex Paquet the Piece bounded on the west side by Donald Steels lot and on the other side by the lot in possession of James McEachern; and unto Michael Paquet the two lots now in possession of James McEachern and Ronald McDonald 160 feet front in the whole. These these four last mentioned lots to run across the farm to the line fence between us and Angus McDonald and to the old woman, the lot bounded on the west by Ronald McDonald now in possession of John Steele and to Jane 100 feet Back 130 feet front next to the old woman and next to that 60 feet square for Anastasia, and to Margaret 50 feet square the lot left to the old woman to be left to Joseph Paquet after the death of the old woman. The rest of the field be equally divided between Michael, Alexander and Marshall Paquet. In the name of God. Amen and to Alex and Marshal Paquet 40 feet front running to line fence to make up for the size of the lots below and it is my will that all the above mentioned property left from heir to heir and must not be sold out of the family excepting two lots I leave to be sold to pay my debts whereupon I lay my hand and seal this

Be it known unto all men by these present that I Fidele Pauchquet of Souris, Prince Edward Island, Farmer have made and declared my last will and testament in ___________ date the twenty day May one thousand and eight hundred and fifty three. I said Fidele Potchet by this presents codicil to rectify and do confirm my said last will and testament.
Further give and bequeath unto my loving three sons, Michael, Alexand, and Marshall Potchet seventy seven and half acres land to be delivered by my executors and my will and meaning is that the codicil be adjunced to be a part and parcel of my last will and testament and that all things therein mentioned and contained be faithfully and truly performed and set down in my said last will and testament
Witness my hand this first day of June one thousand eight hundred and fifty three.
