The Will of Hugh Monaghan (August, 1829 - 29 April, 1913, Charlottetown)

This is the last Will and Testament of me HUGH MONAGHAN of Charlottetown in Queens County, Province of Prince Edward Island, Trader.

I direct the payment of my just debts, funeral and Testamentary expenses from my personal Estate.

I direct my Executors hereinafter named to apply the sum of Two thousand dollars from my estate in having masses sung for the repose of my soul and the souls of my deceased wife and members of my family.

I give and bequeath to my son, Patrick Monaghan, the sum of Five Thousand dollars.

I give and bequeath to the building fund of the St. Dunstan's Roman Catholic Cathedral in Charlottetown the sum of Five thousand dollars, said sum to be paid to the Treasurer of said fund whose receipt shall be a sufficient discharge for the same.

I give and bequeath to my son, Michael Monaghan an annuity of Two hundred and sixty Dollars per year during his natural life, and I hereby direct my Executors to set aside a sum sufficient to answer said annuity which it is my will shall be paid to my said son in weekly payment of five Dollars each.

I hereby direct my said Executors to set aside from my estate a sum sufficient to provide for the support of my son, James Monaghan, during his natural life, said sum to be sufficient to yield an annual income of Two hundred and sixty Dollars at the least.

Subject to the payment of the above legacies and annuities, I give devise and bequeath all the rest residue and remainder of my estate both real and personal, and wheresoever situate, to which I shall be entitled at the time of my decease, comprising Debentures, Bank stock, moneys on deposit, houses, stores, warehouses and household furniture unto my beloved daughter Mary Ann Monaghan. To hold the same to her and her heirs, Executors, Administrators and assigns, absolutely.

Lastly I hereby revoke all other and former wills at any time, heretofore made by me and declare these presented only to be and contain my last will and testament.

I appoint my said daughter Mary Ann Monaghan and James Eden of Charlottetown, Esquire, to be the Executrix and Executor of this my will.

As Witness my hand this 25th day of April in the year of our Lord one thousand nine hundred and Thirteen.

A Codicil to the within will of me Hugh Monaghan of Charlottetown, Trader, which said will bears date the 25th day of April, A.D. 1913, whereas by my said will I appointed James Eden of Charlottetown, Esquire, to be and Executor of my will, jointly with my daughter Mary Ann Monaghan, now I hereby revoke the appointment of said James Eden an Executor of my said will and I hereby appoint Gilbert Gaudet of Charlottetown, Barrister-at-Law to be an Executor of my last will and Testament in the place and stead of the said James Eden and I further direct that the said Gilbert Gaudet when acting as the solicitor of my Estate shall be entitled to make the usual professional charges against my Estate, notwithstanding his office of Executor of my last will and Testament.

The aforegoing Will and this Codicil thereto were proved on the tenth day of May A.D. 1913, on the oath of Justin M. Hynes a subscribing witness thereto respectively, and was filed and registered on the Twelfth day of May, A.D. 1913 and Probate granted same day to the Executors therein named as Certified by Justin Hynes
