The Livingston's of Clyde River

The "MacPHAILS of Clyde River, Lot 31, PEI" have two subsets involving a LIVINGSTON family who came from Mull to PEI in the brig "Rambler" in 1806 and took up land at Nine Mile Creek, Lot 65, PEI. In the tree details that follow, the earliest known members of that LIVINGSTON family are given and the two subsets identified and followed through the years.

In addition, information is provided on the three brothers of Donald LIVINGSTON (who married Flora McPHAIL) and Flora LIVINGSTON (who married Donald McPHAIL). Their details are given in the second generation with some further information on their children that may be of use to LIVINGSTON researchers. My research on them has been limited.

Connections to other parts of the overall MacPHAIL family at Clyde River and elsewhere on the Island will be noted as they occur. The reader may be directed to check them out to follow the family lines.

Please Note: The spelling of names beginning with Mc or Mac used in this tree is based on the spelling used by the individual at the end of his or her life. None of the family who died before 1910 seem to have used the MacPHAIL spelling. All used McPHAIL. My own great-grandmother McPHAIL, a widow, insisted to her dying day in 1924, that her name was McPHAIL and that she was not changing the spelling to that used by her children!

Comments, additions and revisions to this tree are most welcome. Please send to

The Livingston's of Clyde River

First Generation

1. Donald LIVINGSTON. Born in 1750/1751 in Morven, Argyll, Scot. Donald died in Nine Mile Creek, Lot 65, PEI, in Jun 1840. Occupation: Farmer. Religion: Ch. Of Scot. User ID: LV1.

* The family seems to have come from the area of Argyll, Scotland known as Morven. This is the peninsula jutting west from the mainland toward the northeast coast of the Isle of Mull. The Sound of Mull is the channel between Morven and Mull. It is suspected that they likely lived in one of the communities along that channel. No research has been done on the Livingstons in Morven. The family first appears in Mull in the very early 1800s around the Tobermory area as if they have moved there. The marriage records in Mull of sons DONALD (MP212) in 1803 and John in 1805 identify each as of Morven, and the children born after the marriage are baptized in Mull with the fathers still "of Morven".

The extended family migrated to PEI on board the Brig Rambler which departed from Tobermory, Mull about the first week of May and arrived at Charlotte Town, PEI on 20 June 1806. This point of departure is the reason the family remembers their roots as "coming from Tobermory, Mull", although Mull was in reality just a stopping place along the way from Morven.

The party of Donald Livingston, Sr. leased land on the south shore of Lot 65, immediately east of Nine Mile Creek in 1806. A record on the sale of lands of Lord Selkirk shows 100 ac. in the parish of Charlotte, Queens County to Donald Livingston "settlers in 1806 & interest payable 1st of May 1807." The 1841 Census entry for the homestead property as held by Donald (LV115) shows the lease as having been held 33 years [from 1808]. By the 1841 Census the extended family had another 100 acres by verbal agreement at the mouth of Nine Mile Creek immediately west of Donald that was held by John Loveston [born before 1781] with his wife; and 50 acres by verbal agreement held by Alexander Loveston [born 1781/96] and his wife east of the homestead. The 1863 Lake Map shows a D. Livingston with an A. Livingston immediately to the west, and on the west side of Nine Mile Creek another A. Livingston.

Donald is mentioned as a juror at inquest of McIntyre on 23 Jan 1825 and inquest of McEachern on 20 Jul 1828. He advertised in the PEI Register on 17 Jun 1825, 1 Jul 1825, 16 Aug 1825, 27 Aug 1825, 14 Feb 1826, 21 Mar 1826, 29 Apr 1828, 30 Dec 1828. He is mentioned in the Colonial Herald 20 Feb 1840 pg and his death notice is in the 20 Jun 1840 edition of the Herald on pg 3.

A Margaret Livingston [b. 1773/74] came to PEI with her husband James Currie [b.1780/81] and son James Currie [b. 1803/04] from Tobermory on the "Spencer" arriving 22 Sep 1806. She may have been a daughter of Donald and Mary.

Abt 1809 Flora married Donald McPHAIL, son of Colin McPHAIL of Aros, Mull (1743/1744-aft 1786) & Christian CAMPBELL (abt 1748-aft 1786), in PEI. - Mentioned in his parents' home in 1779 Census.

- He seems to have come to PEI as a single man in 1808 possibly with his cousins Mary McPHAIL and her new husband John MURRAY, and her younger brother Angus McPHAIL. He and Angus were fore-runners of the 1810 McPHAIL migration to the Clyde River for they appear to to have acquired properties and begun preparing them.

- It also seems likely that he and Flora LIVINGSTON, who came to Nine Mile Creek, Lot 65 in 1806 with her parents, had an "understanding" from back on Mull for they appear to have married very shortly after his arrival.

- Connection of dau. Jane to this family is based upon best fit rather than proof. It may be that her mother died at her birth.

Subject: Fire at John K. Crawford's

The following is an account of the fire of Jan. 12, 1870 from The Summerside Journal of January 20, 1870.

One of the saddest and most melancholy events that has ever occurred in this part of the country happened in West Point, Lot 8 on the morning of Wednesday the 12 inst in the burning of Mr. John Crawford's house, and very sad to relate Mrs. Crawford and her three youngest children and a boy by the name of Pollard - five in all - perished in the flames. Mr. Crawford and his three oldest daughters and an orphan child about six weeks old, barely escaped with their lives by a window without one article of clothing except what they had on in bed. After a desperate but vain attempt to save those who were dear to them, they retired to the stable and endeavored to keep themselves warm among the cattle until some neighbors arrived to help them all.

The origin of the fire is unknown unless the Pollard boy who was subject to fits may have in some way caused the accident in which he so fearfully participated. There was not an article of any description saved. Mr. Crawford was in very comfortable circumstances; but he is now completely destitute of anything in the shape of clothing, household furniture, and other comforts for his family during the winter. There were about ninety bushels of wheat, a little of which was saved in a damaged condition after the fire had subsided. But the saddest sight of all was the burnt and charred remains that were picked up. They were a sight pitiful to behold. Burned to a cinder! Not a vestige of humanity left! The amount of mental agony that must have passed through that deeply affected husband and father during those eventful hours, no person can describe.

The remains of Mrs. Crawford and her three little children were put into a small coffin, and the boy in another, on Thursday were carried and deposited in one grave followed by a numerously attended funeral. The countenance of everyone testified to the fact that a dreadful calamity had happened. Mr. Crawford is justly entitled to the consideration of the community at large. The inhabitants in the vicinity are preparing a temporary place of residence and are going to make preparations for putting up a house in the spring. Messers John Coughlin and Alfred MacWilliams of Lot 7 and Messers A. & A. Ramsey of Lot 8 are appointed to receive contributions.

We will now give Mr. Crawford's own statement of the accident. He says: "Between two and three o'clock, as near as I can judge, I was awakened by a suffocating sensation, and not knowing the cause awoke my wife, and getting out of bed, I told her something was the matter. I do not remember what answer she made me. I ran downstairs; and the first thing I did was open the door of the room where my eldest daughters were sleeping, attending the orphan child. I called to them to know if there was anything wrong there. They said "No" and my eldest daughter got up and went to the back kitchen, where was a large box stove, to see if there was anything there. On opening the door leading into it, we found the north end, which was further from the stairs, was one solid mass of flame, not realizing the extend of the danger we attempted to quench it, calling at the same time to my wife that the house was on fire. She answered something, I couldn't tell what, and we thought she was on her way downstairs. There was a boy sleeping in that part of the house where the fire was and we thought to leave him a way to escape by leaving the door open. Not thinking for a moment that the fire would rush to the door so rapidly, we ran to the front door and we saw- too late- that we were in imminent danger.

The front door having been fastened up for the winter we had to find some way of getting out. I went to the room where the eldest girls had been sleeping and found that the only way to escape was through the window! I found that there was none there but the two named and the orphan baby. The eldest girl going with me I turned back to try and bring the rest of the family to the window where we could get out but only halfway to the stairs when I was surrounded by fire and smoke, and with difficulty had to find my way back and get those who were there out. I hurried them through the window, calling to those who were left to come this way. I spring out hoping there would be some way of escaping through the front window. I broke it in, but the flames came out so fierce that had anybody been there it would have been impossible to get near them.

There were two little girls sleeping with us and a little girl and boy in a settle bed in the front kitchen. The noise awoke the little girl and she sprang up and ran to the room where her sisters were, not thinking there was any danger she left her little brother sleeping. I can't tell anything more about it or what time elapsed before our kind neighbors came and brought us away. The ones who perished were my wife, aged 34 years, my only son aged five years and eight months; two little girls aged respectively four years and one year and eight months and an orphan boy aged eighteen years. Those who escaped were respectively twenty, twelve and ten years."

Another article in the same materials follows and is in a section about Mysterious happenings in West Point::

An unknown author presents the following:

One story long present in the community is of the John Crawford fire. During the night, fire caught and burned his residence. Mr. Crawford's wife, three children and a boy servant, perished in the fire. The next day the bodies were so badly burned that they were simply taken out and buried in the field. Rumors remain that the fire was no accident. Many community members still insist that Crawford lit the fire himself. What motivation lying behind this action is unknown. If such is the case, it was a dastardly act.

Many strange thing have happened around the Crawford Estate. An air of suspicion still engulfs the place. Passers by have reported hearing a screaming woman. Other have seen unexplainable lights. On occasion the house would appear to burst into flames. The poor woman and children would be seen trying to escape.

Whatever the true story is behind the account, it still remains one of horror. If the fire was accidental then, so be it. But if it was set by a no less than deranged husband and father, the terror of the happening can only triple in intensity. If there is such a thing as a spirit world, certainly those would be the souls destined to walk the earth searching for revenge or peace.

I have no idea who wrote this but some of the other members of the committee (Carol Livingstone, Audrey MacDonald or Patricia Sharpe) might know. I am supposed to be scanning the material and couldn't resist duplicating these parts because of my interest in them.

I have a footnote that I must add. Those people whom I knew who remembered John K. Crawford, did not speak unkindly of him nor did his obituary. I have had it implied to me, however, that both the Ladner and Livingstone ladies were brawny, large framed ladies, built of the stature of European peasant women. John K. was delirious of a "bonny" lass, which Margaret MacDonald would have been, seeing the stature of the MacDonald clan as Grandfather was slim and trim according to the account at the presentation of the medal and pictures I have seen of him. Certainly, Stan, Bert, Jack, the only ones I knew were all slim and small boned people. But it does add a flare to the theory of the fire being deliberately set.

Can't imagine anyone doing that, as the fire so completely destroyed everything he owned that he was left destitute with 3 daughters and a nephew to care for. Knowing the time of the year, old houses would have been cold and there would be huge fires on in less than perfect stoves, in an attempt to keep warm in those severe winters that they experience here in 1800's. I would say that would have been a more logical conclusion, but not so interesting a story.

Another thing to note is that the newspaper mentions a burial and funeral. I know of an existing gravemarker at the West Cape Presbyterian Cemetery. George F. Sanborn says there was a marker there with at least three childrens' names, but it was subsequently broken and some of the pieces are gone and so now the stone only reads about Maria and son George. Another point in defense of John K. was the fact that his son perished. Sons were everything to every member of the family and he would not have deliberately endangered his only name bearer.

- one third to his daughter BARBARA (MP22212) (now wife of Albert Home) paid in cash immediately

[Malcolm then made his mark witnessed by Charles Heartz and this is the end of one page]

- the remaining two thirds to be equally divided for the benefit of his daughter MARY LIVINGSTONE (MP22214) and his granddaughter BESSIE LIVINGSTONE (MP222141), daughter of said MARY LIVINGSTONE.

The executors were to be George Davies and George Scantlebury Senior

Malcolm then made his mark as MALCOLM LIVINGSTONE, dated the 25th of April 1888 and witnessed by Charles Heartz and Roger Godfrey. The will was proved on the 1st of May 1888 on the oath of Charles Heartz. Probated was then granted to George Scantlebury, the other executor having filed renunciation.

- On 22 Jun 1837 Malcolm married Elizabeth McPHAIL, in St. Paul's Anglican Church, Charlotte Town. Rector L.C. Jenkins Marriage by licence and bond 12 June 1837., Witnesses John Thomas Heartz & Alex'r Livingston.

- Elizabeth McPHAIL was born in 1815/1816 in PEI and died in Baltic Road, Lot 31, on 8 Sep 1874. Buried in Clyde River, Restored Pioneer Cem. Occupation: Housewife. Religion: Ch. Of Scot.

- Born 1819/20 by obituary. Her McPHAIL parents have not been identified.

- In the 1841 Census of Lot 31, she is one of two females born 1796/1825. She appears to be Ch. of Scot. religion. The other female may be her sister and may be the "insane" person marked for this family who is staying with a sister for refuge.

They had the following children:

16 i. Son ______ (~1838-1841)

17 ii. Barbara Ellen (~1839->1888)

18 iii. Donald (1841-)

19 iv. Annie (1852-1938)

20 v. Mary (~1845->1888)

8. Alexander LIVINGSTON (Donald2, Donald1). Born on 9 Sep 1807 in Dog River, Lot 31, PEI. Alexander was baptized in Charlotte Town, PEI, St. Paul's Anglican, on 4 Oct 1807. Alexander died in 1841/1848. Occupation: Farmer With Father On Dog River, Lot 31. Religion: Ch Of Scot. >> Baptist. User ID: MP2222.

- He is believed to be one of the 3 males b.1796/1825 in his father's household in the 1841 Census. It is also believed that the female of the same age bracket was his wife, and the 2 young males b.1825/41 were their sons. In the 1848 census no male of Alex's age appears but the young woman b. 1803-32 and two boys b. 1832/48 appear. Combining the two censuses, the young woman was b.1803/25 and the two boys 1832/41.

- Took up 70 ac farm on Tryon Road near east side of Lot 30 in 1844 in lease for three lives. He does not appear at that location on the 1863 Lake Map.

- DOB 1820/21 in 1881 Census. - DOB 1809/10 in 1891 Census. He is living with Angus McPhail and his sister Isabella McPhail on the Bannockburn Rd, Lot 31.

10. Margaret LIVINGSTON (Donald2, Donald1). Born abt 1812 in Dog River, Lot 31, PEI. Religion: Baptist. User ID: MP2224.

- Margaret's connection to this family is not proven. She is inserted here based on her uncles Duncan and Alexander Livingston having a daughter Margaret and her uncle John have a "full" sequence of births of single children [unless there was a twin]. In this family she is in a four year "gap" between known brothers Donald & John.

- On 15 Apr 1839 Margaret married John Michael GRANDIE, in St. Paul's Anglican Church, Charlotte Town. Rev. L.C. Jenkins performed the marriage and the witnesses were John Sentner & John Ladner. Born abt 1810.

11. John LIVINGSTON (Donald2, Donald1). Born on 24 Apr 1814 in Dog River, Lot 31, PEI and baptized in Charlotte Town, PEI, St. Paul's Anglican, on 24 Feb 1815. John died in Bonshaw Road, Lot 30, PEI, abt Sep 1887. Occupation: Farmer On Bonshaw Road, Lot 30, PEI. Religion: Free Ch Of Scot. User ID: MP2225.

- By locating son Duncan in 1881 Census and 1880 Atlas map of Lot 30, and knowing Duncan was on the family farm at those times, checked back to 1861 Census and 1863 Lake Map. Found map shows a N. McFadyen at that location and the 1861 Census has a John Simpson at that location. Checked details given for Simpson entry and noted that ALL date ranges for John Livingston and his family, 9 people in total, exactly fitted the Simpson details. Religion, occupation, farm acreage and place of birth match too. Suspect that census taker heard "Simpson" for a gaelic "Livingston".

Therefore consider that

- The estimate of John's death year is based on the date of his will and the year the 1880 Atlas was compiled.

- He may be the John Livingstone, cattle man, working for R.B. Stewart at Strathgartney in 1870.
